But society has gradually moved to a sense that the law should actively interfere in physical violence that occurs within the family.

The contending parties are held in place by a sense that everyone loses big time if no settlement can be reached, if civil peace yields to civil war. But we can fully expect each party to push things to the brink, to strive to get as much as possible without driving the other side into violent resistance. And thus we can also expect the parties to feel some considerable hostility to liberalism’s moderating mechanisms, to the legal contrivances by which it tries to regulate, contain, and adjudicate conflicts.
